Terms & Conditions

 

z/s Lakši, registration no. 41201012598, address: “Lakši”, Usmas parish, Ventspils region, LV-3619, hereinafter – online store – provides the content and goods available on the website www.laksiskincare.com in accordance with the Terms & Conditions set out below.

 

1. General provisions

If the consumer purchases goods through the website, then such mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia governing the distance contract, including, but not limited to, the Law of the Republic of Latvia Cabinet regulations “Regulations on distance contracts”, etc.

 

2. Making purchases

The prices and specifications of the products sold in the online store are indicated next to the products.

Add the desired products to the shopping cart to place an order. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make a purchase payment to complete your order.

 

3. Payment terms

The billing currency on the site is the euro. The purchase can be paid for by choosing the following payment methods provided by the payment platform SEB:

  • Latvian internet banking payments: Swedbank, SEB, Citadele and Luminor

  • Estonian internet banking payments: Swedbank, SEB, Luminor, LHV, Citadele and Coop

  • Lithuanian internet banking payments: Swedbank, SEB, Luminor and Citadele

  • Visa / Mastercard card payments

NB! Using the online banking payment method, confirm the order and click the “Return to merchant” button.

 

Personal data required for making payments is transferred to a licensed payment institution SEB Banka.

 

The agreement enters into force upon successful payment to the online store’s bank account. If for any reason it is not possible to fulfill the order, the Buyer will be informed and the amount paid will be refunded as soon as possible, but not later than within 14 days after receipt of the notice.

 

4. Terms of delivery

The goods are delivered to the following countries: Latvia, Lithuania, Estonia. Purchased goods are delivered using: Omniva parcel machines. All fees and taxes payable to receive the shipment at the destination of delivery shall be covered by the Buyer. Shipping costs are shown before order confirmation. The purchased goods are delivered to the address specified by the Buyer within 1-7 working days. In exceptional cases, we have the right to send the goods up to 45 calendar days, informing the customer.

 

5. Right of withdrawal

The Buyer has the right to withdraw from the Product within 14 calendar days from the receipt of the Product. The right of withdrawal does not apply if the Buyer is a legal entity.

 

In order to exercise the 14-day right of withdrawal, the goods may only be used for their intended purpose, the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. If the goods are improperly used or damaged, neglecting the goods during use or not following the instructions, if the original packaging of the goods is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refund according to the value of the goods.

 

To exercise your right of withdrawal, you must submit a withdrawal form, which can be found here: https://forms.gle/KXioZcH4bdvB7dFR7 or by sending an application to info@laksiskincare.com within 14 days of receiving the goods. The buyer bears the cost of returning the goods, unless the reason for the return is that the goods do not match the order (for example, the wrong or damaged product).

 

The Buyer is obliged to return the Goods to the Seller without delay, but not later than within 14 days after sending the withdrawal form to the online store. Upon receipt of the returned goods, the online store shall immediately, but not later than within 14 days, refund all payments received from the buyer on the basis of the Distance Agreement.

 

The Seller has the right to withhold payment until he has received confirmation of the return of the Goods or the Goods from the Buyer. If the buyer has chosen a different shipping method than the cheapest shipping method offered in the online store, the online store is not obliged to reimburse the excess shipping costs.

 

The Online Store is not responsible for delays in the fulfillment or non-fulfillment of obligations, or other non-fulfillment due to circumstances and obstacles beyond the reasonable control of the Online Store.

 

The online store reserves the right to refuse to sell the goods and request the return of the goods from the Buyer, if the price indicated in the online store is significantly lower than its market price due to an error.

 

6. Consumer rights for non-compliant goods

The online store is responsible for non-compliance of the goods sold to the Buyer with the terms of the contract or defects that have occurred within 6 months after the date of delivery of the goods to the customer, or at the time of delivery, if such assumption does not contradict the nature or defect. The Buyer must inform the Seller of the non-conformity of the goods immediately, within 2 months after its discovery, i.e. submit a complaint. The buyer can submit a complaint by contacting the online store at info@laksiskincare.com

 

The online store is not responsible for defects that have occurred after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the elimination of defects in the goods or exchange for new goods free of charge.

 

If the goods cannot be repaired or replaced, the Seller shall return to the Buyer all payments provided for in the Distance Agreement. The seller shall provide a written response to the consumer’s complaint within 15 days.

 

7. Processing of the buyer’s personal data

The online store only processes personal data that the buyer has entered when ordering goods, such as name, e-mail, etc.

 

The online store transfers personal data to the transport service provider (s) to ensure the delivery of the goods.

 

If you have explicitly agreed to receive our marketing communications, including newsletters, we may contact you from time to time to provide information about our services and the latest offers. For this purpose, we may process the e-mail address you provided when signing up for marketing communications. The buyer has the opportunity to opt out of marketing communications by notifying us by writing to info@laksiskincare.com

 

8. Dispute resolution procedure

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.

 

The Parties shall resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute is not resolved through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, in compliance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Center or a court of the Republic of Latvia.

 

The buyer also has the right to apply to the European Union’s dispute resolution bodies.
